Terms and Conditions

These Terms and Conditions (“Terms”) apply to your use of our website and mobile application (together referred to as the “Platform”) operated by MK Catering Walsall LTD trading as Quinton Balti ("we", "us", "our"). By accessing or using our Platform, you agree to be bound by these Terms and and agree to our Privacy Policy, which explains how we collect and use your personal data.
If you do not agree with any of these Terms, please do not use our services.
1. Services
We provide an online Platform where users can:
- Order food for delivery or collection from our restaurant
- Book tables for dine-in
- Pay for their orders securely via Stripe
All orders and bookings are subject to availability and confirmation by us.
2. Eligibility
To use our Platform, you must be:
- At least 18 years old
- Capable of entering into legally binding contracts
By placing an order or booking, you confirm that you meet these requirements.
3. Orders & Payments
a) Placing Orders
Once you place an order, you’ll receive a confirmation email or in-app notification. This is an acknowledgment, not an acceptance. We reserve the right to cancel or modify any order (e.g. if an item is unavailable or incorrectly priced).
b) Payment Processing
All payments are processed securely via Stripe, a PCI-DSS compliant third-party payment processor.
We do not store, process, or have access to your credit or debit card details. If you choose to save your card for future use, the card information is securely stored by Stripe. We do not have visibility or access to saved card details.
c) Refunds
Refunds may be issued at our discretion in accordance with our Cancellation and Refund Policy. Please contact us at support@quintonbalti.com for help.
4. Table Reservations
You may book a table via our Platform. Reservations are not guaranteed until confirmed by us. We reserve the right to cancel or amend a booking in exceptional circumstances.
Please notify us if you are running late — your table may be released after a set grace period (usually 15 minutes).
5. Cancellations & Refund
Orders: Orders that are paid by card or wallet, will not be eligible for a refund.
Table Bookings: Table reservations can be cancelled via the Platform (if you are logged in) or by contacting us directly.
6. Allergens & Dietary Requirements
It is your responsibility to inform us of any allergies or dietary restrictions when placing an order or making a booking. While we take precautions, we cannot guarantee the absence of allergens in our food.
7. User Conduct
You agree not to:
- Use our Platform for any unlawful purpose
- Submit false or misleading information
- Disrupt the operation of the Platform
We reserve the right to suspend or terminate your access at any time for violations.
8. Privacy
Our use of your personal data is governed by our Privacy Policy. By using our Platform, you consent to the collection and use of your data in accordance with it.
We use Stripe for all transactions. Stripe’s own privacy policy applies to payment data.
9. Intellectual Property
All content on our Platform (logos, menus, images, designs) is owned by or licensed to us. You may not copy, reproduce, or distribute any part without our written permission.
10. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- Our total liability for any claim related to the use of our Platform shall not exceed the amount paid by you in connection with that claim
11. Changes to These Terms
We reserve the right to modify these Terms at any time. Updates will be posted on our Platform with the effective date. Continued use of our Platform constitutes acceptance of the updated Terms.
12. Communications & Notifications
We may communicate with you via email, SMS and push notifications. Service-related emails (such as order confirmations, booking updates, or account information) are essential and cannot be opted out of.
Marketing and promotional communications, including emails and SMS, will only be sent to you if you have explicitly consented, or if you are an existing customer and we rely on our legitimate interest in accordance with applicable law. You can unsubscribe from marketing communications & notifications at any time by using the unsubscribe link included in the emails, SMS or via your account.
Push notifications are optional and used to enhance your experience (e.g. order status updates, promotions). You can disable them at any time in your device settings or within the app. For more information, see our Privacy Policy.
13. Loyalty Programme
- Eligibility: One account per customer. Non-transferable. You must be logged in to earn and redeem.
- Earning: You earn 10% back on the order subtotal after any discounts and before delivery fees.
- Stamps: You receive one stamp per paid order. After collecting 5 stamps, you can redeem from your 6th order.
- Redemption: Your loyalty balance may be applied up to the order subtotal. Any unused balance is forfeited when you redeem. After redemption, your stamps reset to 1 and a new balance starts from that order’s 10%.
- Combination with other offers: Loyalty cannot be used together with discount codes or other promotions on the same order.
- Minimum payable: If loyalty drops your total below £1.00, we add a surcharge to bring it to £1.00 or you’ll need to add items or disable loyalty.
- Exclusions: Loyalty does not apply to delivery fees, tips, gift cards or similar non-food charges.
- Refunds: If an order is refunded or cancelled, we may reverse associated stamps and balance.
- No cash value: Loyalty stamps and balance are promotional credits, not money, and have no cash value. They cannot be withdrawn, sold, transferred, or exchanged for cash (in whole or in part) and do not earn interest. Redemption provides a discount only against the order subtotal at checkout.
- Changes & misuse: We may correct errors, suspend or end the programme, and void loyalty earned through abuse, fraud or technical error.
- Precedence: If anything on the loyalty page conflicts with these Terms, these Terms prevail.
14. Account Registration
You may create an account to access certain features on our Platform, such as saving addresses, or booking tables more easily.
When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
We reserve the right to suspend or terminate your account if we believe you have violated these Terms or provided false information.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
